Terms and Conditions of Use

These Terms govern the conditions of access, browsing and use of the Platform, as well as the rights and obligations of users and the Operator. The Platform offers, among other features, account registration, a forum of user-generated content (threads, messages and reactions of a public nature), content search and the publication of news related to the «Grand Theft Auto» series.

Accessing the Platform and, where applicable, registering an account imply full and unreserved acceptance of all of these Terms in the version published at any given time, as well as of the Privacy Policy and the Cookies Policy. If you do not agree with any part of these Terms, you must refrain from using the Platform.

The use of certain features may be subject to additional specific conditions which, where they exist, will be made available to you and shall be deemed to supplement these Terms. In the event of conflict, the specific conditions shall prevail with respect to the matters they regulate.

Use of the Platform confers the status of user («User») and means that you have read, understood and accepted these Terms.

«Platform»: the Leonida Hub website and all of its subdomains, pages, features and associated services.

«User»: any natural person who accesses, browses or uses the Platform, whether registered or not.

«Account»: the set of credentials and data that enable a registered User to identify themselves and access the reserved features.

«User Content» or «UGC»: any text, message, thread, comment, reaction, link, image or other material that a User publishes, uploads or transmits through the Platform.

«Operator Content»: the content, software, design, trademarks, databases and other elements owned by or licensed to the Operator.

«Third-Party Content»: trademarks, works and materials owned by third parties, including Rockstar Games, Inc. and Take-Two Interactive Software, Inc.

To access certain features (such as posting in the forum or reacting to content) you must register an Account. Registration may be carried out using an email address and password, or through social login via external providers such as Discord or Google, in accordance with those providers' conditions.

You must be at least 14 years old, or the minimum age legally required in your country of residence to consent to the processing of your personal data, in order to register and use the features that require an Account. By registering, you represent that you meet this requirement.

You undertake to provide truthful, accurate and up-to-date information during registration and to keep it updated. The Operator may suspend or cancel Accounts containing false, inaccurate or misleading data.

You are solely responsible for the safekeeping and confidentiality of your access credentials. All activity carried out through your Account will be presumed to have been performed by you. You must immediately notify the Operator, through [EMAIL_CONTACTO], of any unauthorized use or security breach of your Account.

The Operator is not liable for damages arising from the misuse of credentials due to your lack of diligence in safekeeping them. We recommend the use of strong, unique passwords.

Each User may, as a general rule, hold a single personal and non-transferable Account, unless expressly authorized otherwise by the Operator.

You undertake to use the Platform in accordance with the law, these Terms, public morality and public order, and not to use it for unlawful purposes or in any way harmful to the rights and interests of third parties or of the Operator.

The following is expressly prohibited, by way of example and without limitation: (a) publishing content that is unlawful, defamatory, slanderous, obscene, violent, or that incites hatred, discrimination or violence on the grounds of race, origin, sex, religion, sexual orientation, disability or any other personal or social circumstance.

(b) Harassing, threatening, intimidating or violating the privacy, honor or image of others, as well as disclosing third parties' personal data without their consent («doxing»).

(c) Sending unsolicited commercial communications, spam, pyramid schemes, hidden advertising or repetitive mass messaging.

(d) Impersonating any other person, user, entity or the Operator itself, or misrepresenting your affiliation with any person or entity.

(e) Publishing or distributing content that infringes intellectual or industrial property rights, trade secrets or any other rights of third parties, including pirated material, keys, cracks or unauthorized download links.

(f) Introducing or spreading viruses, malware or other malicious code, as well as performing actions that may damage, overload, disable or impair the Platform or prevent its normal operation.

(g) Gaining unauthorized access to systems, restricted areas or other users' accounts, or attempting to breach the Platform's security measures.

(h) Extracting data automatically through «scraping», «crawling», bots, spiders or other similar means without the Operator's express written authorization.

(i) Using the Platform to disseminate sexual content involving minors, terrorist content or any other material whose possession or distribution constitutes a criminal offense.

Breach of these rules may result in the removal of content, the suspension or cancellation of the Account and, where applicable, the pursuit of any corresponding legal action, without prejudice to any obligation to report to the competent authorities.

The forum and other participatory areas of the Platform allow Users to publish User Content of a public nature, accessible and visible to any visitor and indexable by search engines.

You retain ownership of any intellectual property rights you may hold over the User Content you publish. Publishing through the Platform does not transfer ownership to the Operator.

By publishing User Content, you grant the Operator a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, reproduce, technically adapt, publicly communicate, display and distribute such content in connection with the provision, promotion and operation of the Platform. This license lasts as long as necessary for those purposes and survives, with respect to content already published, the cancellation of the Account insofar as other Users have quoted it or it has been integrated into public threads.

You represent and warrant that you hold all the rights, licenses and authorizations necessary over the User Content you publish, that it does not infringe third-party rights or applicable law, and that you assume full responsibility for it.

The Operator acts as a hosting service provider with respect to User Content and does not pre-screen all published content. Nevertheless, it may moderate, edit or remove content in accordance with the Moderation section.

You are solely responsible for the User Content you publish and will hold the Operator harmless against any third-party claim arising from such content.

The Operator may, without any general obligation of prior monitoring, review, moderate, edit, block or remove any User Content that it reasonably deems contrary to these Terms, the law or the rights of third parties, as well as suspend the access of the responsible User.

If you detect content that infringes these Terms, applicable law or your rights, you may report it to the Operator through [EMAIL_CONTACTO], indicating the URL or location of the content, a description of the infringement and, where applicable, evidence of your standing. The Operator will address notices with due diligence and in accordance with the applicable information society services regulations.

The removal or blocking of content does not in itself give rise to any right to compensation in favor of the affected User.

Where appropriate, the Operator will retain the information necessary to respond to requests from the competent authorities, in accordance with applicable law and the Privacy Policy.

Insofar as the Operator provides a service for hosting third-party content, its liability is governed by the exemption regime set out in the applicable information society services regulations, acting promptly to remove or disable access to unlawful content from the moment it obtains actual knowledge of its unlawfulness.

The Operator Content (including, by way of example, the software, code, design, structure, the «Leonida Hub» trademark, logos, editorial texts and the selection and arrangement of its own content) is protected by intellectual and industrial property rights owned by the Operator or its licensors. Except with express authorization, its reproduction, distribution, transformation or public communication is not permitted.

Leonida Hub is an UNOFFICIAL fan community. It is NOT affiliated with, associated with, authorized, sponsored or endorsed in any way by Rockstar Games, Inc., Take-Two Interactive Software, Inc. or any of their subsidiaries.

«Grand Theft Auto», «GTA», «Grand Theft Auto VI», the characters, settings, logos, images, videos, trademarks and other associated elements are registered trademarks and/or intellectual property of Rockstar Games, Inc., Take-Two Interactive Software, Inc. and/or their respective owners. Their use on the Platform is for informational, commentary, criticism and fan-community purposes, without any intention of creating confusion as to commercial origin or of appropriating others' rights.

Any material belonging to third parties is used, where applicable, under the limits legally established to intellectual property rights (such as quotation or review) or under applicable authorizations. The Platform does not claim any ownership over such third-party material.

Takedown procedure for rights holders: if you are an intellectual or industrial property rights holder and believe that any content on the Platform infringes your rights, you may request its removal by writing to [EMAIL_CONTACTO] and indicating: (i) identification of the affected work or trademark; (ii) the exact URL or location of the content; (iii) a statement of your ownership or standing; and (iv) contact details. The Operator will address the request with due diligence and, where appropriate, remove or block the affected content.

The Platform is provided «AS IS» and «AS AVAILABLE», without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law.

The Operator does not warrant the availability, continuity, error-free or uninterrupted operation, or the suitability of the Platform for a particular purpose. The Platform may experience interruptions due to maintenance, technical failures or causes beyond the Operator's control.

The Operator does not warrant the truthfulness, accuracy, lawfulness, quality or reliability of User Content or of linked third-party content, nor does it assume responsibility for the opinions expressed by Users.

Nothing in this section excludes or limits the rights that mandatory consumer legislation grants to Users acting as consumers.

To the fullest extent permitted by applicable law, the Operator shall not be liable for indirect, incidental, special or consequential damages, or for loss of profit, loss of data or loss of opportunity, arising from the use of or inability to use the Platform.

The Operator is not liable for damages arising from User Content, from the conduct of Users towards each other, or from the content or services of third parties linked from the Platform.

The limitations in this section shall not apply where the law does not allow it, in particular towards consumers in respect of damages caused by willful misconduct or gross negligence, harm to life, physical integrity or health, or in respect of liabilities that cannot be legally excluded.

In those cases where the Operator must be held liable, its liability shall be limited, to the extent permitted by law, to direct and actual damages duly evidenced.

The Platform may contain links to third-party websites, services or content (including social login providers such as Discord or Google), which are provided solely for the User's convenience.

The Operator does not control and assumes no responsibility for such third-party sites, services or content, nor for their privacy policies or terms of use, which are governed by their own terms.

Access to third-party services is at the User's sole responsibility. We recommend reviewing each third party's terms and privacy policies before using their services.

The inclusion of a link does not imply approval, association or recommendation by the Operator of the linked site or service.

You may cancel your Account at any time through the options available on the Platform or by requesting it at [EMAIL_CONTACTO].

The Operator may suspend or cancel your Account, in whole or in part, temporarily or permanently, in the event of a breach of these Terms or the law, or in the event of use that harms the Platform, other Users or third parties, as well as upon request by a competent authority.

Where circumstances permit and the nature of the breach does not require immediate action, the Operator will endeavor to warn the User in advance before adopting cancellation measures.

Following cancellation, the Operator may retain certain information for the periods legally required and in accordance with the Privacy Policy. User Content already published in public threads may remain visible where its removal would affect the integrity of public conversations, without prejudice to the rights granted to you by data protection regulations.

Cancellation of the Account does not release you from compliance with previously contracted obligations or from any liabilities that may have been incurred.

The Operator may modify these Terms at any time, for legal, technical or security reasons or due to changes in the Platform's features.

Modifications will be published on the Platform and will indicate the date of the last update. Where the changes are substantial, the Operator will endeavor to inform registered Users by reasonable means.

Continued use of the Platform after the modifications take effect implies acceptance of the new Terms. If you do not agree with the changes, you must stop using the Platform and, where applicable, cancel your Account.

These Terms are governed by Spanish law and, where applicable, by European Union regulations.

For the resolution of any dispute arising from these Terms or from the use of the Platform, the parties submit to the Courts and Tribunals of [CIUDAD/JURISDICCIÓN], unless applicable mandatory law provides for another venue, in particular with respect to Users acting as consumers, who may bring proceedings before the courts of their domicile.

Should any clause of these Terms be declared null and void, this shall not affect the validity of the remaining clauses, which shall continue to be fully applicable.
